EDIT: Found a better quality pictureI am slightly afraid... and i am pretty sure that is actually Shinichi on the left instead of Kaito like I originally thought...

Actually, if you look closer the hairstyle is different from Kaito's hairstyle.
It is simple to figure out that the person to the left is Shinichi.

Nope, it's definitely Shinichi. You can tell by the little hair triangle at the back and the lack of messy hair. His colours are also more muted than KID's regular outfit; I've got the original for comparison.

I know it looks like Shinichi. I'm saying it's likley that it is Kaito pretending to be Shinichi dressed up as KID... If that makes any sense. >.>

It makes sense theoretically but there's no reason for him to do that in-series, and even less of a reason in a promo photo where they'd want the characters to be as instantly recognizable as possible. Plus I've seen other promo drawings of the characters interacting in those same outfits, and it's pretty clear from the way they draw Ran interacting with him that it's Shinichi.
(Pluuuus you get Shinichi and Conan together in DC promo material constantly. Happens all the time.)
Next, Shinichi's blue for the Kid outfit is lighter than Kid's; Kid's is a powder blue while Shinichi's is more cerulean, which you can see in better quality photos. There wouldn't be any reason to do that unless it the character in question wasn't Kid and they wanted to differentiate. (Not that they differentiated very well, but...)
And finally finally, this is actually a composite of several promotional drawings put together .

Yeah, but you see giant backround people all the time in Detective Conan (especially when Conan is going something very dramatic and Shinichi-esque). it doesn't mean Kaito is a giant ghost, it means he is present (be it in the spirit of the event or while hidden as someone else.
I think that it's Kaito pretending to be Shinichi pretending to be Kaitou. o.O If that makes any sense.

Sorry for the late reply comments tend to get buried and i dont find them till later lol! but yes you are right its hard to tell them apart especially when they are wearing the same clothes... usually you can tell by the hair behind their ears shinichi's is smooth but kaito has some weird spiky thing going on there
