actualy in the pic where it looks like they are the same size is becuse yami stands further away or stands on a bit of a lower platform you see that if you look closely

If you think the height thing is weird in the show, you should look at the manga. In the early volumes of Yugioh Yami is freakishly short. He goes though some crazy puberty thing as the series progresses.

Also, his yellow bangs vary in number. In the beginning of the manga they're all weird and crazy. By the 5th volume his bangs settle down into the style you see all the time.
