Can't believe this took 5 hours, well it was worth it, I think it came out good (I still hate drawing hands) first I drew it out then colored it in with crayola markers, filled in and shaded with prismacolor pencils, a sharpie was thrown in somewhere, then took it to PS and colored in the background and touched it up with picnik, because I dont have a scanner right now and took a pic of it with my DS. I love this game, the first one, the 2nd one is kinda pissing me off (still love that one too XD)

This looks nice, but it looks like you just cropped the game's cover, put filters over it, and moved the luna over part of Mario.
[link] - look. The luna is exactly the same, just with an outline drawn over it, as is Mario. The background also looks the same, just PS filtered.
That makes it . If i'm wrong, I'm sorry, but they just look to similar.

There's a ton of differences. It's one of those things where she heavily referenced it, but there's not enough alike to call it theft.

If you make the face size the same in both of them, you can see how many positioning and sizing differences there are. It was heavily referenced, but she did it on her own.

I can't believe you actually compared, and all the parts you pointed out are not the same, On my drawing, Marios buttons are in a different angle than the game box, let alone I kinda drew them smaller, his left hand (on my drawing) is kinda effed up because well, it was like, 12AM and hands ARE a bitch to draw. Lumas eyes, UM I made mine kinda BIGGER and they're tilted a bit, and the shine, I brightened it up using PS but I left the space white on the drawing itself. Marios eyes, well, i'm rather good at drawing eyes, I love drawing eyes, BUT his right eye IS a tad screwed up, but nothing to really notice, trust me, I know all my drawings mistakes. I color backgrounds on my drawings with either Corel or PS (Because I don't like wasting my Prismas). How you think the background is similar is quiet ridiculous considering last night I was kinda wishing I got it RIGHT but no, I did it fast and without my tablet, and using a random brush for the stars. As for the Luma being closer to Mario, I DREW IT IN A SKETCHBOOK AND I DRAW KINDA BIG SO I SCOOTED IT OVER! But hey, its ok, you probably think that there are no GOOD artists on DA and that everyone steals shit. And maybe (true facts) I DO want to work for Nintendo as a game artist (been a dream since I was 13) I just need to get to Academy of Art University in San Fran, I've been drawing for a really long time now, I don't appreciate someone saying I stole art or crap like that. I've been on DA for like, 3 years now, and NOW I get this? gah >_>;;;

All of those things can be done with a filter, not to mention it wouldn't be that high quality or that straight of an angle if taken from your DSi.
There are thousands of exeptional artists on Deviantart. If I thought they were all shitty I wouldn't have made an account.

so basicly, if I would draw someone with a moustache and a hat, then I'd also be art thieving it? the point of making a drawing is making sure it's acurate.. and as far as I can recall over here, it indeed is acurate, but done in her own way: cause; compared to the art box:
-the arm length is to short,
-the overal button part is triangulair in her drawing, in the box it's squared,
-the M on the hat is thicker then on the box,
-her mario has bigger sideburns
-her ears are bigger then on the box,
-the shape of her mario face is less round then on the box
-the leggs of the star piece are more drawn towards eachother,
-her mario is twisted more towards the screen,
-the eyes of her star are more shiney,
-the cap of the hat of mario is whider on the picture,
-her yellow buttons are smaller,
-her star is more fluffy then the one on the box
-the background is totally different, the stars dont allign aswell...
should I continue?
the point of drawing art, in this case, is making it realistic... so if it would look extremely accurate, then it's only a compliment to the artist...
so dont immediately bash someone of claming she's performing arth theft, when you got no proof.... did you perform an overlay?

as you can see from this picture that I composed, with respect to both redchocoroxas and nintendo for the originaly composed art, you can clearly see differences and that nothing is traced...
and besides the entire discussion, I would strongly advise you to treat people the way that you want to be treated yourself... calling people "dumass" or whatever improper spelling you may use wont make any friends.... in a proper argument you should be able to treat someone with respect, and if you cant do that, then I'd advise you to stop going into a discussion with anyone, since you wont be making a good statement when you dont have the politeness to accept the other person,
