That's what comes to my mind first. Second thing would be, Damn that is yellow. Lol
I think the objects in the back round are somewhat distracting, but only slightly. If it was a complete black back round I think the smiley face would pop more.

It's meant to be missing an eye.
It's only like 3/4 of its head, I think it gives it a better standing out affect 
And yes it's very yellow, sort of like a "SAW" feeling to it.
