tortoise, for sure. A turtle would have smoother skin, and it wouldnt be so large.

A turtle has flippers and swims, whereas a tortoise has elephant-like legs. I can't tell for sure without seeing the legs, but that looks like a tortoise I've seen.

Tortoises are the ones you find always on land. Turtles are found in land and water both.

The contrast between the foreground and background is intriguing.
The angle is between a direct frontal and a semi-profile. In my opinion it should be either one or the other.
All and all a dignified portrait.
