According to my state's law, any atypical pet has to have its defensive mechanisms removed. That would include the stink gland. However, even then they're legally supposed to have their own enclosure. I'd want mine to live inside with me.
Not all states require the stink gland to be removed, though. I watched a documentary on skunk enthusiasts a while back and someone said that they never had any issues with them releasing a stink bomb, despite their skunks not being "altered."

yeah i would think that because skunks use the gland when they're threatened, if they're raised in a calm loving home, they really won't ever need it so they're probably WAY less likely to use it.
