To anyone in Bach's comment section that sees this, no one's denying there aren't direct aspects taken from this fanart ofΒ Penny.
However, I really don't think you can say RT "stole" so much as adapted the fanart.
There are a lot of noticeable differences between the two.
For example, new Penny has boot jets, while 3.0 doesn't.
Likewise, we haven't seen her weapon, Floating Array, as opposed to just the lasers that fire from it. If they do still exist, but are just hidden in her back like before, they may not be new, they may be the original design.
So I really feel like if you'd seek to compare this as equal to the thing with Chris Lee's Trivolver (which really does seem like art theft), I think you're either not looking at this in a way that you either have doubts, or you have reason to hate RT.
I feel RT chose to take aspects of Bach's fanart for the same reason they hired him for the gen:LOCK concept art: his art is awesome.
Let's leave negativity of what happens in the FNDM outside of DeviantArt, a place that RWBY has helped inspire so much creativity.

I also realized a Version of Penny that is truly a will-less Android,
nothing like the happy, "independently thinking" Penny we knew.
This one practically "spits" on everything what Penny was, by
being simply a heartless, soul-less killing machine

It is a Scenario some Fan's including me thought about it, for a little,
"Whitley" is getting raised to be a sneaky, ruthless little Shit by Jacques.
What happens when Whitley gains more and more Influence?
The Day he should become so independent regarding his Power as Hair
to a certain Family Empire,
he could simply get rid of his Father - and then his Influence and Power
would be unquestioned 
could question his Inheritance by also being bloodrelated to their Parents.
So he would need to get rid of them as well ... ...
... ... and why not using a Model of "Android-Person" that could prove
efficient against the TEAM RWBY-Girls on more a psychological Level?

I love the costume and colouring! The long curly hair suits Penny as well. I also like the mechanical wings and bits that reminds me of the Nu Gundam and Genji from Overwatch.Β
I hope we can see her 3.0 version in action and it looks awesome! I wonder what kind of new weapons she's packing!

It would be possible. Androids can be reassembled and repaired, and if her memory chip survived, she'll get to keep her personality and memories as well, unless they meddle with those during the repairs...
But yeah. Penny is certainly the one character where a "resurrection" would make sense as far as RWBY is concerned.
