Not really. They're not claiming they made it. That's like saying MLP vectors are theft. It's not at all. Unless they said they dress this, but they didn't.

Yes, because you're only supposed to upload your own work to DA.  If you upload something to DA, you are, by the terms and conditions of the site, claiming ownership.
