Judging by his lorica hamata (the chainmail hauberk), he looks more like one of the Principes (second row) than the Hastati (first row). The Hastati had only a small bronze breastplate (and the helm and scutum) for protection.

Afaik in this era only the trarii used spears as melee weapons, and the hastati and principes used their spears and early pila as thrown weapons. They hardly used it in melee afaik, only in desperate situations.
