i've got to say, no matter how you defend yourself to yourself, your batty is still a rip on another artists work. it is not an issue of copying the pixels, it is an issue of copying the essential style of an artist and calling it your own.

it was never allowed in the past and it is unfortunate that you believe yourself to be so in the right that you would not remove it at the request of the original author of the batty group of avatars.

i agree with sofine, go to *GalaxyDancer 's page, hers looks exactly like the cartoons she draws, but she doesnt rip em

πŸ‘: 0 ⏩: 1

mkinne In reply to spikey27 [2006-12-11 23:48:01 +0000 UTC]

no, those would still be rips in one sense of the word - they are not original characters. depending on how the rights have been established for the character it could be considered infringement.

πŸ‘: 0 ⏩: 1

spikey27 In reply to mkinne [2006-12-12 00:24:25 +0000 UTC]

uh... its fan art. she never said she made them

everything she submits usually has cartoon characters, and it is also submitted to fan art

πŸ‘: 0 ⏩: 1

mkinne In reply to spikey27 [2006-12-12 05:01:11 +0000 UTC]

getting off topic, no?

also, who is to say that certain fanarts are sanctioned by the rights holders?

πŸ‘: 0 ⏩: 1

spikey27 In reply to mkinne [2006-12-13 00:53:56 +0000 UTC]

uh, that fact that its fan art. ppl trying to draw characters because they like them and the show

mkinne In reply to spikey27 [2006-12-13 05:48:01 +0000 UTC]

what legal basis does fanart hold? big fat 0.

kind of getting back to the topic though, if the original artist asks that you not re-create their work, would you respect that?

FineShit In reply to mkinne [2006-12-11 17:30:37 +0000 UTC]

What about all of the artists that draw EXACTLY like Invader zim or Danny Phantom? I don't hear anyone moaning about them- they just get thousands of views and bootlickers. Maybe its the fact that the "essential style" is so simple, thats its easy to copy? And its always been allowed, apparently. What with all these people who constantly draw the same style as cartoons they see on tv who don't have permission from the origional artists.

Yes, neoliquid. Im still raiding your page

πŸ‘: 0 ⏩: 1

mkinne In reply to FineShit [2006-12-11 23:47:04 +0000 UTC]

depend on the protective rights taken out on an image, you may reproduce, etc. the batties were a limited edition creation by one artist for the deviantART community, hence why they were always treated specially on deviantART. people who draw Invade Zim or Danny Phantom would have to deal with Warner Brothers or whomever as the property right holder, however when it is a specific artist on deviantART, don't you think some courtesy should be used in honoring their wishes? Just like if Warner Brothers (assuming they hold those rights) issued a cease and desist order on the reproduction/characterization of their characters, it would need to be honored.

the problem is the original artists for these tv shows don't complain because a) what system is there in place to verify they are the rights holder? b) deviantART is so far underneath their radar, and c) if anything, when you are copying the characters of a tv cartoon you are probably also a fan of the show and therefore helping, not harming the show. it is a difference between property rights held by an individual artist whose creation is her own and whose rights have always been respected in the past and those held by a corporation who profits from people spreading their characters around since it impacts their bottom line in a positive manner.

if Warner Brothers were to ask deviantART to remove all instances of Invader Zim characterizations due to a rights conflict, do you think deviantART would comply? much of this has to do with changes in deviantART administration/ownership and the "preferential" treatment of respecting the intellectual rights of characters designed specifically for deviantART admins/community leaders' use.

`liquify is my friend, and she doesn't deserve to have her work taken advantage in such a way.

Anjiwa In reply to meredith [2006-11-23 06:09:47 +0000 UTC]

Can people not be mature about this? Seriously, people use other people's works to learn, and if he credited her then what does it matter? Just because a style is used does not mean you have to confront the artist and speak of such. Crediting them is plenty good enough. Anyone could have done that style a million times, doesn't mean their on a community such as dA so that a few other see it. Lets be mature about this whole situation. If Liquify chooses to leave dA over such a small reason, then so be it. But her linking to Neo was a little out of the way when she could have easily done something herself, and kept it very mature. But instead she blew it way out of proportion, and you are just adding to this immaturity.

So lets all grow up a little, and realize that people learn from others, and everyone will often follow another person's style until they can get their own. That is just how it is. Learn and accept it.

Take care.

I did something myself, ~neoliquid hid the comments, so no one but he & I know about them.

Please be fair and don't jump to conclusions here. I talked it over with him, then took it up with $realitysquared . I am not so irrational as to just leave dA without seeking resolution first.

If something's been happening for 5 years (deviations similar to his being deleted), why am I wrong to think it will continue to happen?

Why do I have to accept something contrary to what policy has been in situations like these, since 2001?

πŸ‘: 0 ⏩: 1

Anjiwa In reply to liquify [2006-11-23 17:38:20 +0000 UTC]

Things happen I suppose. Because the comments were hidden I didn't truly jump to conclusions. Thought it seemed more that he might have been hiding comments that were flaming him, so there I may have been wrong, and I will apologize for that. True, these types of things could continue to happen, and that is a saddening thing. But unfortunately I don't know. I do feel bad for assuming like I did, I had been half awake when this whole situation was shown to me, so I will admit to being extremely irrational when doing this comment. But nonetheless.. I hope that with leaving dA, and possibly doing something of your own you will be able to continue your work. But it cannot be guaranteed that people still won't copy, but there is no truly controlling that. These types of things are something that need to be accepted, no matter how little someone wants to. ( I don't know if half of this made sense... )

Nonetheless, if for five years straight deviations such as that had been deleted for your sake and they just stopped, then I understand your frustration, and understand the problems you have with the change. Before I didn't know all of the information other than looking upon it and everything seeming extremely irrational. Nonetheless, I wish you the best of luck, and again I apologize. To both you and Meredith, considering I did jump to such conclusions when I was not completely "there." Please don't think I am sucking up, either. I just actually understand.

Take care.

You've no need to apologise to such an extent, though I do appreciate the sentiment and I am truly thankful for it. I didn't want to leave, and still don't want to, but it all makes me very uncomfortable on a general scale.

Thanks for your well wishes!

I agree. The only person that should be confrontational about this is liquify, who, instead, says she is leaving dA, which, although I wouldn't do if this happened to me, I respect.

I wish people liked my art so much they'd lift the style. :[
