That's actually not true. It's misinformation that was spread through tumblr.
These journals will help clear the confusion:

Hot Topic selling artist's works without permission
A Tumblr post has been circulating, where Hot Topic is selling artist's works as T-shirts in their store, including popular fan art without the artist's permission, deviant artists included. It caught on wildfire when one user linked to deviantART's Submission Policy, stating users gave permission to dA by agreeing to their Terms of Service thereby allowing dA to sell it to third party royalty free.

This is false and inaccurate!
deviantART's Response:
"We appreciate the rallying of the community around the rights of this artist. Rights and ownership of artwork are an important cause which DeviantART Isn't Selling Your StuffSo a friend of mine just posted about this situation, and I saw the post myself, on Tumblr,
about how allegedly DA had sold rismo 's design to Hot Topic to sell as a shirt without letting
the artist themselves know. It seemed really legit, especially after reading the rest of DA's submission policy information.
And I was about to make a journal further spreading this information and letting you all know
that DA is selling your stuff without telling you. It seemed really illegal, and wrong, and considering
the fact that the Tumblr post has been around for two years, frustrating to me that it would still
be able to get away with this stuff. Except, that it hasn't.
