I'm curious - Yaphleen has stated specifically on their original painting that they don't want it reproduced in any way whatsoever - did they make an exception for your tattoo? (Which is admittedly beautiful - I make no secret of the fact that I love your tattooing.)

I asked Yaphleen about it, but received no answer. Anyway I think every artist should be honored if there someone make a tattoo with his(her) art ))

While I can appreciate your reasoning about this, the fact remains however that you made financial profit from her copyrighted work without her permission, for which she can actually sue you. Unless you did the tattoo for free, in which case I guess it really is down to her as to how she feels about seeing her work reproduced when she has specifically stated she does not want this.

The fact is that usually a client finds a picture or photo in the Internet and we are tattooartists doing our job, it is the wish of the client and we doesn't ask them were they find the pictures cause frequently it's impossible to find the source of an image and figure out about copyright.
In our business slightly different rules, if the picture or photo are in the Internet, than it can be used in tattoo. We do portraits and photographs of famous people, posters and screenshots from movies that are protected by copyright for sure, but no one checked it ever and there wasn't been any lawsuits yet.
So I've asked her long ago, and if she will be against, than I'll remove it all.
I will be hope that Mylene Farmer will no sue me

Although I am not an ink tattooist, I do temporary tattoos, and I have moreover been a community volunteer for Body Art on dA for a while, and have been in touch and discussion with many tattoo artists - so I do appreciate the problems you are faced with, with people coming to you with photos and asking for a copy of it on their body. Many tattoo artists do this and make a living from it (you have to make a living, after all). Nonetheless, and this is not something I am alone in stating: you are not a photocopier. You are an artist, you are capable of beautiful original designs - something that clients fail to appreciate, because they come with a picture and a request to have it stamped on their body. Many tattoo artists I know refuse doing such a thing.

At the end of the day, if you sold photocopies of Yaphleen 's work, you would get into trouble, and if you make an exact likeness of her work on somebody's skin, the same principle will technically apply. That is the rule, and it doesn't apply differently to you just because you are a tattoo artist. Nobody has sued tattoo artists in particular over this as yet, but artists have certainly been sued for reproducing and selling copyrighted material. There is no law that protects you by saying "it is different with tattoo artists".

Would you think "it is different" if you were copying the work of tattoo artists like Elize Nazelie (elize), Erin Chance (badtaste) or foxxmax (all of whom are artists who design their own tattoos), just for a few examples?

So what I'm trying to say is, I understand your reasoning and I appreciate that you need to make a living, but I want to point out to you that you're putting yourself at risk and what you are doing is copyright infringement, until a case appears in court to place a specific exemption in the law for a tattoo artist. Ultimately, I'm not going to do anything about this. I'm not trying to get you into trouble or make you feel bad. I just want you to see that this is dangerous to yourself... and that you're not a photocopier machine. You're an artist in your own right.
