"Battle Axe" was the aircraft flown by Lt. Thomas Martin and was part of the elite 475th Fighter Group, 431st Fighter Squadron known as Satan's Angels.

I know the type did encounter loss of control problems when going transonic in a dice and it necessitated the installation of dive recovery flaps.

That's pretty awesome that they could fly that fast. How much truth is there to the suspicion that the P38 was actually a case of industrial espionage against Hughes Aircraft's XF11?

I don't know but they sure look pretty similar. It might just be a case of both companies competing for the same fighter spec and arriving at similar engineering/design conclusions. We will probably never know.
